These conditions regulate the procedure for returning goods, warranty service and handling of claims for goods purchased in the online store thunder.lv.

These conditions apply taking into account the mandatory provisions of the legislation of the Republic of Latvia and the European Union on consumer protection. If individual provisions of this section differ from mandatory legal provisions, the mandatory legal provisions shall apply.

1. Right of withdrawal from a distance contract

The buyer, who is a consumer, has the right to withdraw from a distance sales contract within 14 calendar days from the date of receipt of the goods.

To exercise the right of withdrawal, the buyer must notify the seller of their decision within the specified period by email or other available means of communication, indicating the order number, buyer's name and the product to be returned.

The returned goods must be sent to the seller without undue delay, if possible in full configuration with accessories, instructions, fasteners, wiring and other elements that were included in the delivery package.

If the returned goods show signs of installation, use, soiling, mechanical damage, signs of moisture, signs of opening, modifications or other signs of use, the seller is entitled to assess the reduction in value and withhold the corresponding amount from the refund.

The right of withdrawal does not limit the buyer's right to make a legal claim if the goods do not conform to the contract.

2. Return of goods of proper quality

The return of goods of proper quality is possible within the framework of the right of withdrawal from a distance contract under the following conditions:

  • the goods are returned within the period established by law;
  • completeness, labelling and, if possible, original packaging are preserved;
  • the goods have no damage sustained after transfer to the buyer;
  • the goods have not been opened, disassembled or altered;
  • the goods have not been installed in violation of installation or operating conditions.

If the goods are returned with signs of installation, use or loss of merchantable condition, the seller is entitled to assess the reduction in value and withhold the corresponding amount from the refund.

3. Legal liability for non-conformity of goods

If the goods do not conform to the contract, the buyer is entitled to make a claim against the seller within the period established by law.

Upon discovering a non-conformity, the buyer must contact the seller, indicating the order number, a description of the problem and contact details for feedback.

In the event of confirmed non-conformity of the goods to the contract terms, the seller is entitled, at its option and in accordance with applicable law, to:

  • remedy the defect in the goods;
  • replace the goods in whole or in part;
  • reduce the price;
  • accept the goods back and refund the money paid, if repair or replacement is impossible, disproportionate or has not been carried out within a reasonable time.

4. Warranty conditions for the Thunder electronic active exhaust system

The warranty covers manufacturing defects and malfunctions that occur during normal use of the product in accordance with its intended purpose, the installation instructions and the operating rules.

To maintain the warranty, the buyer is obliged to ensure correct installation, correct mounting direction, proper power supply, proper fixation of components and protection of the product from external factors that are obviously incompatible with normal operation of the device.

5. Cases where the warranty does not apply

The warranty does not cover defects, damage or deterioration in the performance of the product resulting from improper installation, opening, interference with the design, mechanical damage, improper connection, failure to follow instructions, or other actions or factors beyond the control of the seller or manufacturer.

In particular, the warranty does not apply in the following cases:

  • 5.1. The sound generator housing has mechanical damage, deformation, signs of impact, cracks, signs of improper fastening or signs of welding. Welding to attach brackets is permitted solely at the buyer's risk and shall void the warranty on the sound generator.
  • 5.2. The sound generator housing has been disassembled, opened or otherwise tampered with, resulting in the factory moisture protection being compromised.
  • 5.3. The sound generator was installed with the sound outlet facing upwards or forwards in the direction of travel, resulting in the accumulation of dirt, water, road deposits and other contaminants inside the device, which hindered the operation of the device and led to damage to the speaker, deformation of its elements or sound distortion.
  • 5.4. The electronic control units have been opened, disassembled, soldered, repaired, modified or otherwise subjected to unauthorised interference.
  • 5.5. The cables of the original system wiring are damaged, the insulation is compromised, incorrect connections, modifications or other installation defects have been made that have caused a short circuit, overheating, unstable operation or failure of the electronic control units.
  • 5.6. The defect resulted from improper installation, incorrect connection, use of non-standard components, unsuitable voltage, short circuit, ingress of water, dirt, chemicals, impact load, vibration, accident or other external factors.
  • 5.7. The product has been used for purposes other than its intended purpose or in violation of the installation and operating instructions.
  • 5.8. The labelling or other identification marks are missing, damaged, altered or illegible.

6. Important clarification regarding warranty limitations

These warranty limitations apply in cases where the defect or damage resulted from the actions of the buyer, installer, third parties, external factors or improper use of the product.

If a manufacturing defect or other non-conformity of the product to the contract terms is detected, the mandatory consumer rights are preserved to the extent provided for by applicable law.

8. Final provisions

thunder.lv products are supplied primarily on a made-to-order basis. This does not limit the mandatory consumer rights provided for by law, unless otherwise provided by applicable law.

The seller is entitled to make changes to these conditions. The current version of the conditions is published on the website.
